Terms of Service

These Terms of Service ("Terms") govern your access to and use of flowdirective.app (the "Site") and the products, content, and services offered through it (the "Services"), which are operated by Flow Directive ("we," "us," "our," or "the operator"). By accessing, browsing, or purchasing anything from the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. Acceptance of These Terms
These Terms form a legally binding agreement between you and Flow Directive. By using the Site, creating an account, subscribing to our newsletter, downloading a freebie, or purchasing the AI Skill-Loss Audit — Premium Report (the "Premium Report") or any other paid product, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference.
If you are entering into these Terms on behalf of an organization, you represent that you have the authority to bind that organization, in which case "you" refers to that organization.
2. Eligibility
You must be at least 16 years of age, or the age of majority in your province or territory of residence, to use the Services. By using the Site you represent and warrant that you meet these requirements and that the information you provide is accurate and complete.
3. The Services
Flow Directive provides editorial content, research-informed thinking tools, a free newsletter, downloadable freebies, and the AI Skill-Loss Audit (a self-assessment that generates a personalized Premium Report). The Services are informational and educational in nature and are provided for your personal, non-commercial use.
We may modify, suspend, or discontinue any part of the Services at any time without notice, and we are not liable to you or any third party for any such change. Some content may be offered free of charge and other content may require payment, as described on the Site.
4. Accounts
Certain features may require you to provide a name and email address. You are responsible for keeping your account information accurate and for all activity that occurs under your account. If you believe your account has been compromised, contact us promptly at hello@flowdirective.app.
5. Fees and Payment
The Premium Report and other paid products are offered at the prices displayed on the Site at the time of purchase. Prices are in Canadian dollars (CAD) unless otherwise indicated and are subject to applicable taxes. Payment is processed securely by our third-party payment processor, Stripe. We do not store your full card details.
By completing a purchase, you authorize us (through Stripe) to charge the stated amount to your selected payment method. You are responsible for ensuring your payment information is current and valid.
6. Refund Policy
All sales are final. We do not offer refunds, credits, or exchanges.
Because the Premium Report is a digital product that is delivered and made available to you immediately upon payment — including instant access to your personalized report and its downloadable contents — you acknowledge and agree that the product is provided and accessed as soon as your transaction is completed. For this reason, and as permitted under applicable Canadian consumer-protection law, all purchases are non-refundable.
Please review all product descriptions and any free preview materials carefully before purchasing. If you experience a technical issue that prevents you from accessing a product you have paid for, contact us at hello@flowdirective.app and we will work to resolve the access issue or, where appropriate, re-deliver the product.
Nothing in these Terms excludes or limits any statutory rights you may have under Canadian consumer-protection legislation that cannot be waived by contract. Where such rights apply, this policy is read subject to them.
7. Intellectual Property
All content on the Site — including text, graphics, reports, frameworks, logos, course materials, freebies, and the design and layout of the Site — is owned by or licensed to Flow Directive and is protected by Canadian and international intellectual-property laws.
When you purchase a product, you receive a limited, non-exclusive, non-transferable licence to use that product for your own personal use. You may not reproduce, redistribute, sell, resell, modify, or create derivative works from our content without our prior written permission. Free freebies may be downloaded for your personal use and may not be redistributed.
You retain ownership of the personal information and audit responses you provide, and grant us a licence to use them as described in our Privacy Policy to operate and improve the Services.
8. Acceptable Use
You agree not to:
- Use the Site in any way that violates applicable Canadian or international law;
- Attempt to gain unauthorized access to any part of the Site, its systems, or another user's information;
- Interfere with or disrupt the Site, its servers, or the networks and services connected to it;
- Scrape, copy, or systematically retrieve content from the Site without our consent;
- Use the Site to transmit any harmful, offensive, or unlawful material, or to harass, defame, or harm another person; or
- Misrepresent your identity or affiliation with any person or organization.
We may suspend or terminate access for anyone who, in our sole discretion, violates these standards.
9. Disclaimers
The Services are provided for general informational and educational purposes only. The AI Skill-Loss Audit and its Premium Report are not professional advice — medical, psychological, legal, financial, or otherwise — and should not be relied upon as a substitute for consultation with a qualified professional. Your use of the Services is at your own risk.
The Site and its content are provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable Canadian law, Flow Directive disclaims all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of Liability
To the maximum extent permitted by applicable law, in no event will Flow Directive, its owners, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of (or inability to use) the Site or Services.
Our total aggregate liability for any claim arising out of or relating to these Terms or the Services is limited to the amount you paid us for the product or service giving rise to the claim, or, where no purchase was made, to CAD $20.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable Canadian law, including liability for fraud, fraudulent misrepresentation, or gross negligence.
11. Indemnification
You agree to indemnify and hold harmless Flow Directive and its affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your violation of these Terms, your misuse of the Services, or your infringement of any rights of another party.
12. Third-Party Links and Services
The Site may contain links to third-party websites and uses third-party services (such as Stripe for payments and Kit for email delivery). We are not responsible for the content, practices, or availability of those third parties. Your interactions with third-party sites and services are governed by their own terms and policies.
13. Privacy
Our handling of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Site you consent to the collection, use, and disclosure of your information as described in that policy.
14. Term and Termination
These Terms take effect when you first use the Site and remain in effect while you use it. We may suspend or terminate your access at any time, for any reason, including a breach of these Terms. Upon termination, your right to use the Services ends, but the limited licence you received for any purchased product continues subject to these Terms. Sections that by their nature should survive termination — including ownership, disclaimers, limitation of liability, indemnification, and governing law — will remain in effect.
15. Governing Law and Dispute Resolution
These Terms and any dispute arising out of or relating to them or the Services are governed by the laws of Canada and the province in which Flow Directive operates, without regard to conflict-of-laws principles. You and we agree to attempt to resolve any dispute informally first, by contacting us at hello@flowdirective.app.
If a dispute cannot be resolved informally, the courts of the applicable province will have exclusive jurisdiction. Where the applicable consumer-protection legislation provides for a different forum or process, that provision will apply to the extent required.
16. Consumer-Protection Notice
These Terms are intended to comply with Canadian federal and provincial consumer-protection legislation. If any provision is found to be unenforceable under such legislation, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force. Nothing in these Terms affects any statutory rights you cannot contractually waive under the laws of your province or territory of residence.
17. Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms on this page with a revised "Last updated" date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms. If we make material changes, we will provide notice on the Site or by other appropriate means.
